Will My Side Of The Story Matter In Mediation?

June 17, 2017 – Polly Tatum

Will My Side Of The Story Matter In Mediation

Many people feel like their side of the story isn’t being heard and respected in their divorce. These people often hire attorneys to tell their story for them in court at a great cost. If you’ve considered divorce mediation, you may be wondering if you will be able to tell your side of the story during the process and whether that will affect the outcome. If open communication is a priority for you in your divorce, mediation may be your best option.

Mediation can help couples divorce with dignity and mutual respect. Battling in court leaves little room for respectful communication and often silences the spouses while their attorneys do the talking for them. To avoid this, many couples decide to file for an uncontested divorce on no-fault grounds. This means neither spouse is to blame, and both spouses agree to the terms of the divorce.

If you feel like mediation is right for you and feel your side of the story is important to tell, speak with an experienced divorce mediator. Once you sit down and discuss the process for divorce, it may become clear that a divorce is really like a business contract. You should come to the table equipped with the ability to put your unresolved feelings aside so you can create a legally sound separation agreement. The mediator does not expect you to both agree 100% and bend to each other’s needs. Rather, the mediator will expect some disagreement over the issues. The mediator will be assisting you and your spouse with respectful communication and amicable negotiations.

Your side of the story does matter. The key to a successful mediation is using your convictions about the divorce as motivation to achieve a favorable outcome. Again, this isn’t always easy, but working with a skilled mediator will give you the best chance of having your story heard and your needs met. Also, consider working with a counselor to work through your emotions pertaining to the divorce. Going into the divorce mediation process with a clear mind and well-defined goals can help you achieve the outcome you are hoping for.
