Risks In Divorce: Mediation Vs. Litigation

April 11, 2018 – Polly Tatum

Risks In Divorce Mediation Vs. Litigation

Many people think the odds are stacked against them in divorce. They may start the process already on the defensive, ready to fight in court for what they want. Divorce litigation is full of risks. You take a risk when you hire an attorney to get you what you want through negotiations. If they don’t succeed, you are out the costs, plus a judge will end up deciding for you. Those mediating their divorce may take some risks as well, but mediation is relatively low-stakes when compared to litigation.

Your risks are quite significant in litigation, mostly because of the time, money, and confidentiality you invested into the process. Hiring an attorney to handle your divorce for you means you are entrusting this person with your future. Still, some people are left feeling like their attorney did nothing for them. The more experienced an attorney, the more likely they can get you what you want. A less experienced attorney may be more affordable, but they may get you nowhere. If your attorneys cannot successfully negotiate with each other, a Massachusetts Probate and Family Court judge may end up deciding on your case. While fairness and the well-being of your child will be kept in mind, you may not be happy with the judgment.

In mediation, your risks are less significant, and you and your spouse are in more control of them. Hiring an experienced Massachusetts mediator may be a risk, but your future won’t be in their hands. They will not be negotiating with another mediator and only have you to answer to. Mediation also keeps you in control of your divorce. The more control you have, the fewer risks you take. Instead, you can make calculated, educated decisions about your future with the help and guidance of a knowledgeable mediator. If your mediator is experienced and you and your spouse are prepared, there are very few risks.

Consider divorce mediation if you are concerned about risking your future well-being and financial security in your divorce. Divorce litigation can take months; meanwhile, you may be worrying about whether your attorney is doing his or her job and what the outcome may be. Mediation removes this uncertainty. Highly experienced mediators are well worth the investment. Look for a mediator who specializes in divorce mediation for the best chance at success.
