What Are Wills & How Do They Work?

Wills are legal documents that allow individuals to specify how they would like their assets to be distributed after they die. Individuals can also use wills to appoint guardians for minor children and pets and to outline the distribution of their assets. Wills must be executed in accordance with state law in order for them to be valid. No one knows when their time will come, but it is important to be prepared for death nonetheless.

Another important thing to do in preparation for death is to create a living will. A living will is a legal document that allows you to specify your end-of-life medical care preferences. This can be extremely helpful for your loved ones in the event that you are unable to communicate your wishes yourself.

Creating a will and living will give you the peace of mind of knowing that your loved ones will be taken care of according to your wishes, even if you are no longer able to do so yourself. If you do not have a will or living will in place, now is the time to create one. You can consult with an experienced wills lawyer at the Law Office of Polly Tatum to help you create these important documents.

Reasons To Create Or Update A Last Or Living Will:

  • Do not have a last will or living will
  • Have minor children
  • Have a DIY/form-generated will and want to upgrade to a more robust document
  • Moved to Massachusetts and want to update your will to comply with MA law
  • You and/or your spouse are “getting up there in years”
  • Have a blended family / 2nd marriage
  • Recent illness or adverse medical diagnosis
  • Want to transfer your business to the next generation
  • Going on vacation or an extended trip
  • Having surgery
  • Have a special needs child
  • Pending divorce
  • Want to leave an inheritance to a spouse, children, or loved ones
  • Want to support charitable interests

If you wish to update your Will or Trust, you may create a codicil. This is an amendment to the original document that must be drafted, witnessed, and signed in the same manner as the original. You may also create a new Will or Trust that reflects your current needs.

What is the difference between a Trust and a Will?

The terms Will and Trust are sometimes used interchangeably. However, this is not correct. There are some differences between the two.

A Trust, on the other hand, is a financial instrument that allows the trustor to transfer their assets under the management of a third party, also known as the trustee. Depending on the type of trust, it may offer significant protection from creditors and other suits against the estate.

A Will is a legal document outlining an individual’s final wishes. This can include how they want their personal affairs to be handled, including burial arrangements, etc., along with how they want their property to be distributed.
